Hungary started prosecuting alleged terrorists for both core international crimes and terrorism offences in 2019, with the first indictment being filed in September of that year. The first verdict, part of the same case was issued in December 2020, finding the defendant guilty of crimes against humanity of murder. Ever since, this case has been pending on appeal at different instances.
Genocide, crimes against humanity, and war crimes are criminalised in Chapter XIII of the Hungarian Criminal Code (HCC). Provisions concerning terrorist conduct are contained in Chapter XXX HCC. Section 3(2) of Chapter II allows for the prosecution of core international crimes on the basis of universal jurisdiction. According to Section 4(1) of the Hungarian Code of Criminal Procedure (HCCP) prosecution or investigative authorities are obliged to launch criminal proceedings when becoming aware of a criminal offence, for example through reports filed by individuals or NGOs pursuant to Section 376(1) HCCP. Cases concerning terrorism and core international crimes are heard on first instance level at the Regional Courts. Appeals in such cases are heard before the Regional Courts of Appeal, with further appeal being possible to the Kúria (Supreme Court).
